JURISDICTION OF CONTRACT
If not actually the case, the contract under which you use this website shall be deemed to have been made in England, and the construction, validity and performance of these terms and conditions of use shall be governed in all respects by English law and the English courts shall have non-exclusive jurisdiction in respect of any dispute between you and Modern Lighting Solutions Ltd concerning your use of this website.

CHANGES AND TERMINATION OF SERVICE
Modern Lighting Solutions Ltd may change or withdraw any of the services described or products shown on the modernlightingsolutions.co.uk website and shop at any time without notice.
All prices displayed are shown in GB Pounds Sterling and are shown with and without Value Added Tax (where applicable) charged at the rate of 20%. Delivery charges set out below.
UK Shipping Rates
Online orders that include only products under 2 meters in length will be charged our Standard Shipping Rate of £10 plus VAT.
Online orders that include any product that is 2 meters in length will be charged our Oversized Shipping Rate of £15 plus VAT.
Online orders that include any product that is 3 meters in length will be charged our Oversized Shipping Rate of £25 plus VAT.
Highlands and Islands can be charged more, depending on location.
BUYING FROM US
Our website has been designed to offer the option of easy online purchasing. If you are not comfortable buying online, then you are free to call us to make your purchase between the hours of 09.00 and 17.00 Monday to Thursday and16.30 Friday. Alternatively, you can collect your items from our trade counter in Sittingbourne. Outside of these hours, please leave your details, and we will call when our office re-opens.
Occasionally we offer discounts across our site. This is sometimes done automatically or occasionally by us posting a discount code for insertion during check-out. We also occasionally email promotions to our customers if they have subscribed to our mailing list.
We use the full PayPal payment system. You can pay via your PayPal account or buy using your credit or debit card. Alternatively, feel free to call us and place your order via the phone, or we can invoice you, and you can pay via BACs. We take all the usual credit and debit cards.
If buying online, when you check out, you will be directed to our payment page. Section 5 is for your card details. This area is an iframe and is directly linked to PayPal; although it looks like it is on our page, it is actually a PayPal window embedded in our page. This is done for security and your peace of mind.
During online checkout, SSL Extended Validation certificates protect our site. We have the highest level. You are within the PayPal iframe window when you enter your card details. This allows PayPal to process your transaction. You would be on their security system if you checked out via PayPal Direct. We do not hold your card information. If you order and pay by phone, we will input your credit or debit card details into the terminal system provided by PayPal. We do not store your card or banking information on our systems or website for security reasons.
If you are a trade customer and wish to pay via bank transfer or company card, please get in touch with us. We are unable to take cheques.
Most of our items will be shipped from our UK warehouse in Sittingbourne via a third-party courier company. In all cases, your goods should be with you in two to seven working days unless specified. Some of our goods are sent directly to you from the manufacturers we deal with. Again, these items are normally delivered within two to seven working days or sooner. Goods will only be delivered to the address on the order placed electronically or via telephone to our office. We can not be held responsible for delivery companies making failed or late deliveries. If they attempt to deliver and there is no one to sign, they will attempt delivery again the next working day. If, after three attempts, the delivery has not been successful, then the product will be returned to our warehouse.
Shortages in your delivery need to be reported within 48 hours. After this time, we cannot take responsibility for missing items. Often, goods can be left on-site, and things can go missing or get damaged.
As we use third-party courier companies to deliver our products, we can not be held responsible for goods not being delivered on time through no fault of our own or third parties. If goods are paid for in advance, we will do our utmost to arrange delivery on time. Goods are delivered by third-party couriers. We do not deliver goods ourselves.
If an item is not in stock, we will contact you within 24 hours with a new delivery date. If this new delivery date is unacceptable and the goods have already been paid for, we will refund you in full. We can not be held responsible for goods not arriving on time due to errors in our system or that of the delivery companies. It is always advisable never to book your installing electrician until you are in possession of the goods.
Delivery is from £10.00 +vat up to £15.00 +vat, or £25.00 +vat to Northern Island, depending on the products ordered and where they are going. Modern Lighting Solutions reserves the right to charge additional delivery costs for areas outside the British mainland and the Scottish Islands and Highlands.
If you cancel your order during check-out, your payment will not have been deducted from your card.
THE GOODS SUPPLIED BY US
All items supplied by Modern Lighting Solutions Ltd are deemed to be of an electrical nature and, therefore, should be installed by a registered electrician. Should your electrician make a mistake during installation and damage the goods, this will be the responsibility between the electrician and purchaser. Should goods fail due to poor or incorrect installation, we cannot repair or replace them free of charge. Please ensure your electrician is fully qualified and gives you a certificate of installation.
FAULTY OR MISSING GOODS
If goods are found to be faulty in the first few days after delivery, they will be collected and replaced. After 14 days, but before the end of the manufacturer's warranty, if goods are found to be faulty, please get in touch with us via phone or email firstname.lastname@example.org. We will issue a return number to you along with our Kent warehouse address so you can return the goods for repair or replacement. If our Sittingbourne warehouse cannot fix the unit, we will return it to the manufacturer for inspection and repair. If the manufacturer cannot repair it, they will replace it. All goods carry a minimum one-year warranty unless stated otherwise. Shortages in your delivery need to be reported within 48 hours. After this time, we are not able to take responsibility for missing items. Often, goods can be left on-site, and things can go missing or get damaged.
If you order as an ordinary private consumer, you may cancel your order within 14 days of making it and receive a refund. Goods must be unused and in their original unmarked packaging. If you do wish to cancel, please email email@example.com requesting a return number. You will be responsible for the cost of returning the items safely to our Sittingbourne warehouse address that we give you. Once the goods are back, we will check them and refund your original transaction minus any delivery charge we incurred.
All products ordered, in error or not required, which have been ordered by or delivered to companies or businesses will be subject to a 25% handling charge with the cost of return carriage to be incurred by the customer. For the avoidance of doubt, orders with a corporate email address given are included. No returns will be accepted after fourteen days have elapsed following delivery, for whatever reason.
Returned goods will not be accepted without a Returns Note number which can be obtained from us. Please email firstname.lastname@example.org. Unless we send you another address, all goods must be returned to Unit 6, Precision 2 Industrial Estate, Bingham Road, Sittingbourne, Kent, MH10 3TR.
Once issued, the goods in question must be received by us within seven days; otherwise, the Returns Note is cancelled, and NO FURTHER REFUND OR RETURN will be accepted.
Goods built to order are non-returnable unless faulty.
When you receive your goods, if the package appears damaged or tampered with, either refuse the package or sign "damaged" or "incomplete". Signing for an item as "unchecked" will not form a valid basis for a claim. If you discover any damage when you open your package, please call or email us immediately. We have to make insurance claims within 72 hours of delivery. We cannot pursue claims for damage in transit after this time. Should you wish to return a damaged product, please telephone us at 0203 805 2288 or email us at email@example.com, and we will advise you on the returns procedure for that product. If, immediately after installation, you discover a fault with your fitting, Modern Lighting Solutions Ltd can not be held responsible for the cost of installation or de-installation. We will arrange to collect the goods that must be put back in the original packaging. In all cases, goods need to be physically checked for damage within 24 hours, or we cannot accept them back as we cannot claim from the courier.

All goods sold on this website, or via any other means, remain the property of Modern Lighting Solutions Ltd or their suppliers until paid for. The goods' risk element (if any) is transferred to the customer upon delivery. However, the ownership shall still remain with Modern Lighting Solutions Ltd or our suppliers until payment is received.
Modern Lighting Solutions Ltd will not be liable to you, or any third party, for any direct, indirect, consequential, special or other damage resulting from the transmission from this website to your computer systems of viruses, worms, trojans or other destructive items, however, caused, such damage to include, without limitation, loss of profits, interruption to business, loss of the whole or any part of a program or any data howsoever stored whether saved on a computer system or otherwise. You accept the risk that data or information transmitted electronically via the Modern Lighting Solutions Ltd website, email or otherwise may be lost, miss-directed, intercepted or interfered with before reaching its intended destination or accessed by unauthorised third parties and may be exploited unlawfully by such third parties. Payment for goods on the Modern Lighting Solutions Ltd website is by Debit or Credit Card only unless agreed by the owners of Modern Lighting Solutions Ltd. Payment can be made in UK Pounds only through our secure transaction service currently operated by PayPal and is subject to the terms and conditions of their service. You agree to review and comply with the terms and conditions of any specific agreement that you enter into with PayPal and/or other Modern Lighting Solutions Ltd payment service providers in connection with the licensing or purchase of any product or service. PayPal will ask you to supply certain information, including but not limited to credit card or other payment information.
